Medical Negligence Compensation

Medical Negligence CompensationThe process of compensation claims of medical negligence

Medical negligence arises where care by a health professional is below what is considered an acceptable standard and causes injury. To successfully pursue a claim for clinical negligence, it is necessary for a plaintiff to prove the one hand that a mistake has been made, and secondly the extent of the consequences of this error.

Under the National Health Service, NHS Trusts have a legal responsibility for errors made by employees of the Trust. GPs are legally responsible for their own actions. Hospital doctors and GPs, however, patients need the same duty of care.

The legal concept of medical negligence is a relatively recent development, the first case in the United Kingdom in 1932.

In 1995, the National Health Service Litigation Authority (NHSLA) was established to investigate and, if necessary, to defend the claims of clinical negligence, or adjust to hospital care when they arise. Claims against GPs are, however, treated by a number of advocacy organizations physicians who work more like insurers.

In 2003, a review of procedures for medical negligence was made happened to a number of unsatisfactory findings. In general cases too long to resolve and are costly to investigate, and the NHS has been accused of dragging their feet and do not deal with claims fairly and promptly.
